Terms & Conditions

This Agreement governs your purchase and use of all FORESTER CREDO LIMITED Limited services, including Web Hosting, VPS, Dedicated Servers, and IT Consulting.

1. Definitions

  • "Company", "We", "Us": Refers to FORESTER CREDO LIMITED Limited (Company No: 16995618), registered in England & Wales.
  • "Client", "You": The individual or corporate entity purchasing the Services.
  • "Services": Any infrastructure, hosting, consulting, or development work provided by the Company.
  • "SLA": Service Level Agreement, defining the guaranteed uptime and performance standards.

2. Account Registration & Security

2.1. You must provide accurate and complete registration information (KYC). We reserve the right to suspend accounts with false information.

2.2. You are responsible for maintaining the security of your account credentials (SSH keys, passwords). The Company is not liable for any loss resulting from unauthorized access to your account due to your failure to secure your credentials.

3. Payments & Billing

3.1. Subscription Services: Hosting and Managed DevOps services are billed monthly in advance. Invoices are generated on the 1st of each billing cycle.

3.2. Consulting Services: Development projects require a 50% deposit before work commences, with the balance due upon completion/milestone delivery.

3.3. Taxes: All fees are exclusive of VAT. VAT will be added where applicable based on UK/EU tax regulations.

3.4. Late Payments: If payment is not received within 5 days of the due date, we reserve the right to suspend the Services. Data may be deleted after 30 days of non-payment.

3.5. Chargebacks: Any chargeback or payment dispute initiated without prior contact with our support team will result in immediate termination of all services and a permanent ban.

4. Acceptable Use Policy (AUP)

You agree NOT to use our infrastructure for:

  • Hosting or distributing malware, viruses, or botnets.
  • Phishing sites or fraudulent activities.
  • Sending unsolicited bulk email (SPAM).
  • Cryptocurrency mining (on non-dedicated instances).
  • Any content that violates UK law or copyright regulations.

Violation of this AUP will result in immediate termination without refund.

5. Service Level Agreement (SLA)

We guarantee a network uptime of 99.9% during any monthly billing cycle.

5.1. Compensation: If uptime falls below 99.9%, you are eligible for a Service Credit of 5% of your monthly fee for every hour of downtime, up to a maximum of 100% of the monthly fee.

5.2. Exclusions: SLA credits do not apply to downtime caused by: (a) Scheduled maintenance; (b) Force Majeure events; (c) Client's own configuration errors or software.

6. Intellectual Property

6.1. Client Data: You retain full ownership of all data, code, and content you upload to our servers.

6.2. Company IP: All background technology, scripts, and automation tools used by FORESTER CREDO LIMITED to deliver the service remain the intellectual property of the Company.

7. Limitation of Liability

Important: Please read carefully.

7.1. To the maximum extent permitted by law, FORESTER CREDO LIMITED Limited shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.

7.2. Our total liability for any claim arising out of these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.

8. Termination

8.1. By Client: You may cancel your subscription at any time via the client portal. No refunds are issued for partial months.

8.2. By Company: We may terminate this Agreement immediately if you breach these Terms (e.g., AUP violation or non-payment).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of London.
